Federal Estate Tax (Death Tax) Planning
The federal estate tax is an excise tax levied on the transfer of a person's assets after death. In actuality, it is neither a death tax nor an inheritance tax, but more accurately a transfer tax. There are three distinct aspects to federal estate taxes that comprise what's called the unified transfer tax: estate taxes, gift taxes, and generation-skipping transfer taxes. Nevada Probate and Estate & Trust Administration
Probate and estate administration are the processes through which estate assets are transferred after death. In Nevada, a probate court proceeding is required for estates valued at more than $20,000. Nevada also requires appointment of a personal representative and a formal probate court proceeding for estates of more than $100,000. Nevada Spendthrift Trust
The Spendthrift Trust Act allows an individual to establish a self-settled spendthrift trust. A "self-settled spendthrift trust" is a spendthrift trust in which the Settlor is the Trustee and the Beneficiary of income and principle. A "spendthrift trust" is a trust which, by its terms, creates a valid restraint on the voluntary and involuntary transfer of the interest of the beneficiary. Thus, under the Spendthrift Trust Act, an individual can create a valid trust whereby he or she is the Trustee (i.e., in control of the assets), he or she is the beneficiary (i.e., can use the assets) and the assets are protected from creditors.
